About Covenants
Valle Cay is governed by its covenants, By-Laws, Rules and Regulations, and the North Carolina Planned Community Act. The purpose of these governance documents is to provide a consistent yet diverse natural mountain (Blue Ridge Parkway) look and feel to Valle Cay thus assuring the beauty of our neighborhood and preserving property values.
Watauga County, the location of Valle Cay, has few land use (zoning) regulations thus deeded restrictions are necessary to assure a diverse yet consistent mountain “feel and look” mix of single family residences while assuring that the investments of property owners is protected. Governance of Valle Cay has been consistent over the years, first by Mr. Steve Loflin, the developer, and now by the Valle Cay Property Owners Association. The result is a uniquely beautiful and isolated “Island in the Sky”.

Restrictive Covenants
Restrictive covenants in Valle Cay limit the use of property to residential purposes, limits leases, and, through Architectural Guidelines, assure that exterior construction meets the established standards of natural beauty. Restrictive covenants also specify landscaping, retention of trees, fencing, and criteria for property upkeep.
Affirmative obligations
The major affirmative obligation is the duty of the property owner to pay annual assessments. Assessments are established through a specified budgeting process and are used for two purposes: (a) to fund the common expenses of the Property Owners Association (POA) and (b) to build capital reserves for improvements to major community assets (e.g., roads, lakes, etc.). Property owner input is invited as part of the annual budgeting process.
